General Terms and Conditions (T&Cs) for Vacation Rental
Arrival/Departure. Generally, check-in is possible from 3:00 PM on the arrival date. Check-out must be completed by 11:00 AM on the departure date. Other check-in and check-out times can be arranged individually with the landlord. If the tenant does not arrive by 10:00 PM on the arrival date, the contract will be considered terminated without further notice to the landlord, after a period of 48 hours. The landlord or their representative may then dispose of the property freely. A (partial) refund of the rent due to early departure is not generally possible.
Scope. These General Terms and Conditions (T&Cs) apply to all contracts between [Company Name] (hereinafter referred to as “Landlord”) and the guests (hereinafter referred to as “Tenant”) regarding the rental of vacation apartments offered on the website [Website URL].
Contract Conclusion. (1) The contract for the rental of a vacation apartment is concluded when the tenant makes a booking through the website, and the landlord confirms this booking via email or other means. (2) The tenant is obligated to provide truthful information when making the booking.
Landlord’s Services. (1) The landlord will provide the tenant with the booked vacation apartment for the agreed period, according to the booking confirmation. (2) The landlord is not obligated to provide additional services, such as breakfast or cleaning, unless explicitly agreed upon.
Prices and Payment. (1)The prices for renting the vacation apartment are based on the rates listed on the website. (2) The rental price is due after the booking confirmation and must be paid in full no later than [x] days before the arrival date. (3) Payment can be made via [e.g., credit card, PayPal, bank transfer].
Cancellation and Withdrawal. (1)The tenant can cancel the contract before the start of the stay. The cancellation must be made in writing (via email). The date of receipt of the cancellation notice will be considered. (2) Cancellation fees are as follows:
• Up to [x] days before arrival: [xx]% of the rental price
• Less than [x] days before arrival: [xx]% of the rental price
(3) The landlord reserves the right to cancel the contract in case of force majeure or unforeseen circumstances that make rental impossible. In this case, the tenant will be informed immediately, and any amounts already paid will be refunded in full.
Tenant’s Responsibilities. (1)The tenant agrees to treat the vacation apartment and its furnishings with care. (2) The tenant is responsible for any damages caused by them or their fellow travelers during the stay. (3) The tenant agrees to leave the apartment broom-clean at the end of the rental period and dispose of garbage properly. Dishes should be clean and stored in the kitchen cabinets.
Data Protection. The tenant agrees that necessary personal data will be stored, modified, and/or deleted in the context of the contract. All personal data will be treated as strictly confidential.
Liability: (1) The landlord is only liable for damages caused by gross negligence or intentional misconduct. (2) The use of the vacation apartment is at the tenant’s own risk. The landlord is not liable for any lost or stolen items belonging to the tenant.
Final Provisions: (1) Photos and text on the website or in the brochure serve as a realistic description. A 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g., furniture), as long as they are of equivalent quality. (2) Any changes or additions to these T&Cs must be made in writing. (3) If any provision of these T&Cs is found to be invalid, the remaining provisions will remain unaffected. (4) German law applies, and the competent court for any disputes arising from this contract is the court in St. Goar.
